so bout a week ago(friday night), i was driving in the left hand lane on i think it was kings way, was sitting on 50 and was pulling up along side a vintage taxi who was in the right lane (one of the ones that do pub crawls in the city).
as we enetered an intersection at speed, the taxi began to merge into my lane and took out my rear qtr pannel and rear door on the drivers side, also scratched my rim and ripped the bumper off..
i then pulled over and he did the same, gets out and says it was my fault, how it could have been my fault was beyond me? i then proved him wrong and he offered a cash settlement of $100. i told him that was a joke and i want his details. i got his details and told him id call him on monday and get him to phone his insurance company to make a claim as i have 3rd party and my insurance company wouldnt care.
i called him on the monday and he said he didnt want to go through insurance and that i should get some quotes then inform him when i get them. he also again offered a cash settlement of 400 which i refused.
i got some quotes all to a ballpark price of $1700.. i called him today to inform him and he says i will give u a cheque for $1500 and we call it even, im happy and ur happy as apparently its still somehow my fault?
how can i get this man to make a claim on his insurance? my insurance company will charge me $300 for them to take the matter off my hands but i shouldnt have to pay for anything as he hit me!?
can i get the police involved or something? i just want my car fixed and the matter to be over!
any help would be greatly appreciated!
cheers
could be worth making a cop report, just so there is evidence of it happening, but he seems happy to give u $1500, which is $100 more than u'd get if u got ur insurance company involved. all depends on how much effort u want to put into it.
doesn't someone work for a insurance company on here?
I don't see why your insurance would charge you as they would charge the fee's to him.
Anyway you can use www.claimsmadeeasy.com.au (http://www.claimsmadeeasy.com.au) a mate of mine used them and got his car fixed, that way you can take it to expensive panel shops and get it looking mint.
police report would have to be the way to go as for insurance guys im pretty sure genki or capt.xav work for shannons might be worth throwign them a pm
bloody taxi undrivers!!!
years and years ago a taxi driver sideswiped my dads mates work vehicle and said "i didnt see it"
the work vehicle was a B-Double
A police report wont do anything.
Ring your insurance company and they should be able to chase it all up for you at no cost to you. I just went through the same thing. Called them, they got everyones version of events and because I had the other persons details they said 'go get it fixed here and we'll sort the rest'.
Got an awesome repair job, didnt pay a cent, havn't worried about a thing since.
IF your not at fault your insurance company will handle ALL of it. Just call them give them the details and they will chase him and make him pay whatever it costs to repair it. Pretty sure you even get to pick repairer...
Good luck mate
the thing is im a p plater, and can only really afford 3rd party fire n theft, im insured with RACV, i called them in regards to the situation and they told me it would be $300 at my expense for them to chase the matter up.. i might give them another call and see what the go is.. im keen to pick my own repairer though! im just waiting on another quote to work out if its worth taking the 1500.

RACV are nothing short of painful to deal with, good luck, I had to wait 6 weeks for one of my work utes to be repaired, full of excuses and no help at all.

I think you should go read an insurance policy. Because your dead wrong.
we had this happen when i was in my mates car i on chapz i ended up jumping in the cab we went threw his wallet and finaly found something with his home address he was trying to give us his taxi number!!!
new guard 80 cost of paint 120 cost to cabby 640 got to love big quotes
Go through your insurance, it should not cost you anything if your not at fault.
*Be wary of Taxi companys, they have good lawyers backing them, you will probably receive a letter of demand for damages that have been done to the cab. (majority of taxis are damaged & poorly repaired anyway).
At least if you notify your insurance company, they can handle legal matters on your behalf.
Melb taxi drivers are pathetic, got no idea, lie and when they have a accident & they are at fault, they generally flee Australia back to there homeland, to escape.
umm go to a good panel beating shop they should handle the claim for you and everything cops have nothing to do with insurance claims all they can do is persist the person
rapid smash repair coburg did all mine and handled it well

But if he admits to it there's enough proof there.
Anyway if he doesn't pay up(the total cost) threaten him to take him to court. Then I'm sure he'll pay.
go to police and record the prang details
get a couple of quotes for your damage and send 1st letter of demand to cab driver. he'll most likely pass that onto the owner who'll end up claiming or the driver may just pay you direct
Cabbie's are only allowed 3 at fault prangs before they their insurance company will no longer cover them and if they are not covered they can't get a cab job... hence why they are reluctant to go through proper channels.
Report the accident, although not sure after it's happened so long ago if he will admit fault..
but i'd say just go to your insurance company, pay the $300, get a proper repair done, and let them handle the rest..
If he gives you 1500, your short $200 from your 1700 fix anyway.. and if you get a 1500 fix.. well, as petros says.. "you get what you pay for"...
And yeah ank, i'd closer quote something like that at 1K, but most panel shops will throw in extra "things that need to be fixed" or "2 hours to remove rear bar @ $70 p/h".... Especially if they hear it's an insurance repair...
Or actually... ask the panel shop if they do insurance repairs, if they are linked with RACV, they can do all the claims etc for you.. now that I think about it, thats what i did for my 4wd years ago... admittedly he was the guy across the road from my dads shop and probably looked after us better, but still, i'm sure others can do that...
Still though, worse comes to worse..$300 would be the way to go...
P.S. I think after the accident your motor hasn't been running right......Turbo seems to have disappeared....
