Had a car incident, strange situation need some advice!

No road markings on google maps? Maybe the lady didn't know that she had to give way to her right? Sounds like she didn't know how to suffice plentifully.

If you dont know that you have to give way at an intersection then you shouldn't have a license.

In that case there should be a mandatory IQ rating of at least 120 before being allowed on the road. that should help.

As far as I'm aware even if you had of swerved to miss this person and had a head on with someone oncoming you're still at fault. I thought the rule was yeah they ****ed up but they didn't make you turn right and hit a tree, you could have turned left and POTENTIALLY avoided it all with no damage. Maybe I'm wrong but I was under the assumption that thats how insurance works with this sort of thing.

update: spoke to "legal aid services" and they told me to send a demand letter with quotes attached and give them a short time frame to reply also spoke to a local solicitor who said the same thing and said that if they caused the accident and the damages, irraspective of whether their insurance will want to pay, they are still liable for my repairs and i can sue them for the damages and just represent myself in civil court (rather than paying a lawyer) she also said if they tell me to shove it again when they get the letter, she'd send another demand letter for me from her office so yeah ill let you guys know when/if i hear back after i send my letter Some original photos have not been recovered yet.

Letters of demand are just a bluff in the hope that someone will fall for it.

its no bluff, im down 2.5k, i will take them to court for it, s*** has got to be done. it gives them a chance to get it over and done with and settled and if they still refuse yeah it shows youve been reasonable and given them time, consideration and understanding just want this **** over and done with and my car fixed and to not be out of pocket for it

hey guys, havent added to this in a fair while! soo sent my letter of demand and got no reply at all (sent it registered post and she signed for it so they definitly got it) then went back and spoke to my solicitor, she charged $250 for her time and to send a new letter of demand... 1 week later she called me and told me that this womans insurance company sent her firm and email saying they were taking full liability for the damage! since then i had AAMI send out an assessor and they approved my highest quote (i didnt show them the lower ones) and now im waiting for AAMI to get back to me about how they want to settle the claim... (they are wasting my time delaying me, but outlook is looking good!) ill be happy when its all said and done tho... 4months since the accident.... Some original photos have not been recovered yet.
