I cant understand how is is still allowed to drive,
From the herald sun updated yesterday afternoon:
A SRI Lankan man who is alleged to have killed another driver while drag racing has been granted bail and will be able to drive on Victorian roads.
Shyam Sachith Jayasinghe, 27, who lives in Hawthorn, has been charged with culpable driving over the crash on Tuesday.
Police allege he was taking part in an illegal drag race in Dandenong when his car slammed into the vehicle being driven by Afghan refugee and father-of-one Hamedjan Hussaini.
Mr Hussaini, 31, is thought to have been on his way home when he turned into the path of the drag race.
Mr Jayasinghe appeared in the Melbourne Magistrates' Court*with his left arm in a sling after suffering injuries in the collision.
The prosecution argued that the Sri Lankan national could be a flight risk because he had no real ties in Australia and had the means and ability to flee.
But Magistrate Simon Garnett said the prosecution's allegation was "speculative''.
While it was possible Jayasinghe could be a flight risk, the seriousness of the charges meant the matter could take up to two years to be resolved, the magistrate said.
He did not restrict the accused's licence after Jayasinghe's lawyer, Damian McNally, argued he would need it to do his job as a sales representative.
The magistrate ordered surety of $10,000 be paid and that Jayasinghe surrender his passport and stay away from international points of departure.
He must not leave Victoria and will have to report daily to Camberwell police station.
In an out-of-sessions court hearing in Melbourne last night, Leading Sen-Constable Lindon Walker, from the Brunswick major collisions Investigation unit, said the Sri Lankan national and an as yet unidentified driver in another vehicle were driving level with each other at speeds estimated to be a minimum of 120km/h - twice the speed limit of the section of the Princes Highway in Dandenong.
"Prior to the collision he had become involved in an unofficial drag race with another vehicle,'' Leading Sen-Constable Walker said.
The court heard witnesses told police Mr Hussaini had plenty of room to make a right hand turn from the opposite side of the highway until the two cars, racing level with each other, crested a rise in the road near the intersection of the highway and Henty St.
After slamming on the brakes, police estimate Mr Jayasinghe's silver Honda Accord was still travelling at 104km/h when it hit the passenger side of Mr Hussaini's car, the court heard.
Mr Hussaini died at the scene of the accident and Mr Jayasinghe was taken to The Alfred hospital.
Police took him into custody after he was released from hospital at about 2.30pm yesterday.
He explained to the bail justice he had suffered a shoulder injury in the crash and was suffering from bruising to his left arm, leg and across some parts of his body.
A red Holden sedan involved in the drag race and its driver are being sought by police.
