That's exactly the point, they don't have to prove it. You have to prove that you weren't doing something wrong. I would disagree with my wheelspin being willful and unnecessary, but when I argued with the cop he just told me "well take it to court then, I'm quite willing to go to court." Of course I couldn't take it to court, having no witnesses who saw anything except for his buddy in the cop car who obviously wasn't going to back me up. The police would be believed over me, because apparently I am a hoon and a menace to society. I am guilty until proven innocent, and that's why he challenged me to take it to court.

i funny as it sounds, u need to have a tape recordered, or video tape, and before they start, explain that u want to tape everything that is said! and always have it running in your car, so i u do do something (when u don't mean to) and u can prove u did everything to stop what u where doing! that would fu(kem and they would have different idea with the way they talk to u! like i have said many times, they would rather fine u and give u the ****s and send u home then find u around a poll or tree!

See my rant in the 'thursday night fingering' thread for my thoughts on this and its relation to the 'justice' system. What I discovered with this offence, was that in order for the police to establish 'unnecessary and excessive noise', all that is needed by definition of the element is to show that 'the police in their discretion believed it was unnecessary and excessive noise'. Thus, if the police say you did it, then there is no way of arguing the point. As I said, see the other thread as to my thoughts on how this perverts the justice system, reverses the onus of proof, and reverses the presumption of innocence. I was lucky, in that when I appealed the ticket I was given (which was utter rot btw!...oh, and it was written as 2 points on the ticket) the magistrate told the police that she was not comfortable with the element of 'wilful' and strongly recommended to them that they may like to ammend the charge to the lesser one of 'start a vehicle in a way the makes....etc' = $240 and no points. She also refused to order court costs against me - all in all, quite a lovely lady. :P I have more to say, but if I go further it'll turn into a full-length thesis, so I'll leave it at that! Steve.

Yeh your coppers are farked in your great sunny state At schoolies got to see great police work at its best when they decided that smashing my mates head against a gutter and arresting him was fair as he ripped into them about state of origin while being highly pissed, got done with a $500 fine as he missed court which was at 9am when he got released at southport at 5am. Ohh yeh and in Brisbane i saw a number of roundabouts that looked scarily familar to the ones exchaser drifted around in his cruise Wish we had roundabouts like that back in NSW. And exhaser answer your PM. Some original photos have not been recovered yet.
