Not exactly true re: being polite....always try to be, but if you are pulled over by the 'State Traffic Task Force', you will find them arrogant, and you will get a ticket. Do not say anything but for your name & address.
Harrassment, discrimination.......'Persecution' is the word I like to use. My plan is to look into becoming involved with the council of civil liberties (or whatever the civil libertarians call themselves) here in Brisbane, and push for reform to the system.
Steve

now thats an idea, but from my experience in dealing with beaurocrats over the years, the only thing they are truly interested in is, "whats in it for me and how can i look good to the people and get away with it".
iwould love to start up something that shows the community that "car lovers" can be resonsible citizens and it is the few and exceptions that bring it down for us all.

...it's true. lol - but you think I'm bad, you should hear my flatmates! Crazy shouting leftys!
I just have issues with the current system of traffic infringement notices. As well as giving far too much power to the discretion of Police Officers, the system is not set up to cater to people who are innocent of those traffic charges levelled against them by sometimes arrogant and over-zealous officers. It is a situation which is all too common, but the court system is just not used to dealing with it.
It is so rare that someone actually appeals something (comparatively speaking), that when they do, they are also very rarely sucessful. The thing is, if you choose to excerise your right to have a matter heard by a court, and a still found guilty of the offence, the fine which may have originally started as a couple of hundred dollars, can escalate up to a few thousand dollars ($5000 maximum to be exact, but more likely to be around $1500 is found guilty after having plead not guilty and going through a trial).
The governments reasoning behind the ability to impose this higher penalty, is in that the court process takes time, and costs money, and this needs to be made up for by those who are found to be guilty after having 'unnecessarily' taken up the courts time (ie: they didnt win, and "may as well have paid the fine in the first place") in the imposition of higher fines and court costs. I say phoo-ee to them. :P
It is every persons right to have any charges laid, determined impartially and objectively by a court of law. In having the threat of a higher fine than one would have otherwised been liable in having just paid the ticket straight up, it is a dissuasion for people to elect to exericise their rights. Effectively, this process acts to perverse the course of natural justice, and make the choice of exercising ones rights a determination of a fiscal kind as opposed to any real ability to face ones accusers and be subjected to right and just treatment, as should be the case. It is apparantly our right to do so, but with the above in mind, it simply acts as a facade in place so as the government can appear to be doing the 'right' thing in having the option there.
Another unfortunate consequence of this system is in its reversal of the presumption of innocence. Again with the above in mind, in effect how the system works with respect to traffic matters, is that one is considered guilty of the offence accused, unless and until you can prove otherwise beyond a reasonable doubt thus reversing the onus of proof and leading to the perversion of justice.
Back to the original point of police powers however, after having gone through the above, it can be seen that police know this process full well, and know that they can issue tickets on a whim, as even if they are elected to be heard before a court, the facts as read by the prosecution are taken to be accurate, until and unless the accused (you & I) can show that they were otherwise. In this situation, unfortunately there is not a whole lot which can be done when you come across a bad egg in the Police Force.
Jay - you wanted 'Law geeky'? there ya go! hahaha
If anyone actually made it through all of that - congratulations!
As for politics....who knows
A safe place - on the cards.

i'm very aware of the cars around me. that helps ALOT. being able to spot the cops from far away does too. and that means behind u as well as far behind u.
and exchaser i know what you mean, i was "supposedly" losing my licence - got done on the m1 ( 1 am, only car out there) when i had my p's @ 134 in a 100 zone, on queens birthday - was double demerit points. blah blah, court time. got it back straight away. been pretty cautious since. it's just not worth the fines anymore.
i dont dont sympathise for me friken i was hust sayin 50 cops 100 cars family's and workers in the wrong place at the wrong time. we didnt get done for a thing so the cops preety much were revenue hunting.. doing there job yes fair enough but when i saw a 17 year old girl finishing work from maccas in a car she can just survive drivin while she is tryin to fund her uni life get pulled up sent to pineapple street and then ordered to get a tow truck to get her home. 4 f ucks sake. its not me getting done but that this pisses me off more than me sitting there for 3.5 hours. my 2 cents im over this sh i t. whens the next cruise im keen for some chillin out and cruisin. yeah andy man ill give a holla out to u my nigga next time were out and about. its been a while dude.
