Hey guys i just need some opinions i know this isnt about vls but hey its car related, first of all this is about my mum. Last wednesday 22nd march, a lady pulled out in front of my mum my mums car a ford maverick/GQ patrol with a bullbar, the only damage to my mums car was dinted in front left quarter panel, broken blinker and the bull bar on the left side was pushed back. Well old mate said well theres $2000 grand for a new bullbar and whatever other costs, apparently it equaled $5500 75% of the insured price so they classed it as a repairable write off. When i know my self i cauld repair it for under $1000 plus the VIV. So my mum went and called RACV to discuss getting a second quote and the lady said a cheques been sent in the mail and my mum said no i want to get a second quote, so the lady canceled the cheque. Anyway we went to a panel beaters today to organise to look at the car to organise a second quote. They said it was all good ect we will do it tomorrow. So we go to where the car is kept a RACV registered repair place and they say the car has already been towed to warragul and heading to melbourne to the auctions. I was with my mum at the time and we were both shocked, mum goes when did it go the bloke said last week, mums pipes up and says thats bull, i was only here on monday and he goes oh it must have went tuesday or wednesday this week. Seemed a bit suss. So we left and the old girl is on the phone now trying to figure out where here car is ect. My question is this seems to be totally illegal, how can they just take teh car away when we havent decided whether we are going to keep it or not? It seems like a load of bull****. Personally i reckon the young bloke whos the mechanic there and is into mavericks is keen on it and probably has it. Whats your oppinions? Like its total bull**** we still have possessions in the car.

Get back on the phone to insurance, ask for a supervisor. Ask for resolutions immediately. At the same time try and get a hold of some Ombudsman and see if they can get involved. It sounds like a bit of mis-communication, the lady could have cancelled the cheque for the payout, but the memo may not have worked its way down the line in time for the wrecking yard.

does not sound right at all when a lady pulled out in front of me when i had my corolla, we called insurance and they organised a towie to come pick it up. The towie looked at the damage and said that we should take everything out as its possible that its most likely a write off. It was then towed to the assessor who then called us again to let us know that it would be repaired but once again gave us the option of picking up anything we needed out of the car and let us know that we were free to come look at the car anytime during the repair process... I'd be calling your insurance company up and askign them to investigate as technically they have stolen your cars with goods still inside

**** insurance companys right off, especially budget direct, a friend of mine had an accident in her mazda 6 or whatever, and they declined paying out anything because of an unsecured amplifier in the boot...... Even though the accident was not her fault, and the other drive had already agreed to pay for the damages, Budget Direct still took it upon themselves and declered it a write off, suspsended the rego and it was Towed to woop woop. Funny how RACV the people who wherent even insuring the car, found it, picked it up and fixed it no questions asked.

Mum was on the phone today to them saying she was gonna get a second quote and the lady said we have sent you a cheque mum was liek wtf, i want to get a second opinion so the lady said ill cancel the cheque and you go and get the second opinion/quote and when we went to go look at the car it had already been towed away. Like wtf. We were never informed of anything, like what if we wanted to keep the car ect?

nobody has 'stolen' the car and there's nothing 'illegal' and nobody is 'into Mavericks why not just take the payout and go out and buy a new car with it very easy for you to say you'd fix it for $1K the car becomes the property of the insurance co once they've paid you which it appears they have and pls hit the spacebar a few times, i've done it for you to make it easier to read

I have just been through a similar circumstance with my motorbike My bike was in an accident with the other party at fault, there insurance company told me it needed to be assessed and that they needed to be taken away to be assessed. A few weeks later the told me it it was written off and the check was being sent out but i want my bike back so i made them send it back because i also want to dispute the value as they were only going to give me $3700 when its worth $5000 not including all my off road modifications. in the end they sent it back. its your Vehicle and they have no authorisation to take it but they just do because people dont know their rights. so long as the cheque has not been banked as then it is legally there's

very different circumstances there Philby as in your case someone elses insurance co 'claimed' your car and was going to pay out a relatively random amount the one we are discussing is where it's his mum's car and her insurance co has possession of it and will probably be paying the insured amount less the excess = simple zac: your mum needs to deal with this via the phone to the insurance co btw is this really 'nasty'

I will post up a pic of the car soon, why would my mum have to pay excess when it wasnt her fault? She didnt pay any excess.

provided she identifies the driver at fault she almost certainly won't have to pay excess or have it deducted from her payout my mistake

What a Joke. Total cost to repair that in parts 2nd hand would be under $500 with the bull bar repaired. Regarding the loose amp and budget direct, if the amp did not cause the insurance claim (eg: electrical fire) - then it really has no participation in the payout and therefore, can be disputed in court. You need to get the law on your side to fight these kents as they get away with everything. Anyhow, I always get my solicitor involved when dealing with the slimy insurance companies. No win, no fee for me ( we always win ) and they add their $1000-$1500 fee on top which the insurance pays in their payout, but does not come out of my payout. I love it when we get to the magistrates court 9 months after the accident (yes they drag it out, submitting low ball offers in increments of $500) and we mediate right up until the court hearing to settle before court. It's all a big boys club guys, the lawyers representing the insurance companies are all friends with my lawyers and if you get a Friday appointment at the courthouse, its all said and done by 11 so they can have a long lunch. Sometimes they are fighting each other, other times they are fighting together. It is the outright job of the insurance to pay AS LITTLE as possible within your contracts and statutory rights. They often go over the limit and get away with it, until you pull them in line with the rules of the law. They squeeze dollars out of the situation in two ways - 1. Lower payouts to the client based on a made up technicality and 2. squeeze the quotes from the panel beaters and suppliers down till the panel shop is making $15-$22 /hr for remove/refit costs and $30-$40/hr for paint and panel work INCLUDING repairs, filler, paints and materials. The assessor will often try to come in and bargain down the quote to an unreasonable level and you have to pump it back up again. A farking joke really. So how does the insurance make money? On their float! They have hundreds billions of dollars accruing interest in various markets, investments and stocks - the policy payments go into a big money bin, where they often get a 10-25% return on their dollars per year. They are losing money with every payout, so that's why they are stingy. Very similar to a bank - but you can only claim money based on a legitimate claim/accident.

I know how ridiculous, thats why we are gonna get the car plus $3920 and i reckon we will be heaps in the clear. But will we have to get a viv or something?
