Hey guys,
need a little help here. For interest's sake, I want to find out how the police can determine the speed of your vehicle, not using a speed camera or a hand-held radar. Specifically I'm interested in the procedure the police use for determining the speed of a vehicle they are following. It's difficult to find this information on the net and the police themselves are not overly helpful. I don't want to have to submit a FOI application, but I may have to if nobody can help.
As a side note too, is a speeding ticket valid if there is no alleged speed or speed limit written on the ticket?

I think it is 50-100m they need to follow you for to get the reading... But if ever your pulled over and accused for speeding simply ask to see the radar gun reading... If no reading then tell them to have a nice day.

Jordy - i believe that certain types of incorrect or lack of information can make a ticket null and void, there is certain criteria that must be met, but i'm unsure of where this can be obtained. It is also my understanding that to be charged or issued a ticket for speeding, the speed must be recorded first by some medium or device that can be calibrated etc - ie camera or radar, i think that they can't get you unless they have that, as i've had cars chase me (obviously speeding) and pull me over, but they couldn't write a ticket as they didn't have a radar .....

Thats bull****, I have been done driving past a cop who was sitting at lights.
He chased me down and gave me a fine for speeding, I asked to see the gun and he said "I estimated you were doing this speed". They really can do whatever the fark they want. You dont have a leg to stand on.

Thier speedo's are calibrated regularly and they go off this. They are also trained to 'estimate' your speed.. which is crap.
They need to be following you for some metres (cant remember how far) and there must be a second person in their car to see the speed too. But, they can write one out if they want. At the end of the day its a coppers word against a modified car enthusiasts!

This is very true, i got done the first time cuz they tailgated me so they knew what speed i was doing & i didnt think to question anything about the speed, 2nd time i got done i asked the cop if he has a speed radar he said no he was behind me so his speedo pretty much told him & i said thats fine so if i take this to court its ur word against mine, so ill see you in court, cop tried to blackmail me with more fines, went down to his police station spoke to his sergeant & they cleared my fines...anyone can estimate someones speed, just take em to court....

Hmm interesting... I have a ticket, with no alleged speed or speed limit written on there. It simply says "exceed speed limit" and $150 fine. It was issued by a police officer who followed me along a twisting turning road, and therefore couldn't see me for the entire time he was following me. His estimate of my speed is wayyy off. Can't really post exact details here, but PM me if you wish to know the full story.

Yes you do actually. Ask for the date the cop car last had it speedo calibrated. If it wasn't in the last few weeks, take it to court and watch it go out the window, in NSW anyway...
A cop cant just say I think he was going this quick. They have to have PROOF in a court, and they have to allow for error. Less than 10% of the limit, start laughing, and dont bother wishing them a nice day!

17-07-06, 11:30 GMT+10#11 He's estimated my speed as 80 in a 60 zone. If I take it to court can they increase my penalty, or is it just a question of upholding/throwing out the original fine?

You wont get out of it, anyone that says you will is dreaming, Unless you have a 100% driving record.
people saying they have to follow you for a km, Must show you the gun etc.
Have no idea, police make up there own rules and when you take it to court they are ready for anything you have to say.

As far as I am aware, they can get you for speeding without having to show readouts ect.

17-07-06, 14:42 GMT+10#17 I'm keen to challenge it, but I still want to know if they can increase my penalty? Like if the cop gets to court and says "ohhh I think he was actually going 100 in the 60 zone" can they give me a bigger fine and more points?

17-07-06, 17:43 GMT+10#20 I'm pretty sure you'll get let off cause it doesn't state the speed...I'm sure I spoke to someone that had that exact same thing happen...my speeding fines have always listed the speed and how much i was over.
