last week some dumb **** hit my car, no insurance i've calledthe number she gave me and she dont even live there. I found out last night she has no issurance and now the mother says "i'll do u a favour" i know a person who does my panel beating and u can get it fixed there.
thats not on but the only why i get my money will be to give it to them, im going to go for cash in hand. And if i have to give it to the panel beater what should i do before i give it to them. Photos, remove stereo.
If if they do a **** job and im not happy what can i do about it, police? **** their car up?
thanks for help

wel yeh, you should hav called the police right when the crash happened, call the police and tell them what happened, and go to vic roads, get a form to report the crash there, that way vic roads has your side of the story too cos u gotta do that l8r n e wayz.
take a tonne of pictures of the car and maybe where u crashed aswell, the more the better

Go to the local court and see the chamber magistrate, he'll set you on the right path.
Don't get your car fixed by their panel beater. You don't have to get the car fixed at all in fact but the driver or the owner must compensate you for the damage they caused.
And yes report the prang to the police too

well how half arse is this, i didn't have a moble on me so i went to the local cop shop the cop said yeh no one was injured so there is no point making a report. i couldn't argue with him. i rang the dumb ****s mum today, i got the number through some serious detective work (mainly threats) and she said that a day and a half wasn't enough to get a number for a panel beater, she said she had a life. Shes also trying to say that there isn't as much damage as the quote costs. Im calling her again tonight and getting the number if i get ****ed round one more time i will goto cop shop and ask for advice besides that i can't do anything besides letter of demand. i cant afford a lawyer or court fees etc. im just glad i wasn't written off and the damage aint serious.
i'll keep you all posted if your interested.

I might be insane, but i swear to god my mate told me about some sort of independant investigation service into auto accidents! But i can't for the life of me remember what it was called... He either used it himself or got done by it lol i cant remember but im fairly sure it exists. If you can find out more info about them i guarantee it'll be better than telling the cops. That report will sit on some guys desk for weeks being ignored...

The details for the police are merely to cover your arse and for stats purposes. Yes they may be able to help you with an address for her.
Don't keep ringing the mother, she could apply for an AVO against you if she's a smart allec
You don't need a lawyer/solicitor
Go to the court as I suggested and start the 1st letter of demand happening asap addressed to her at her mothers house.
Keep a record of all correspondence you send
Start quietly ( without them realising it) trying to find out where she lives/works so that you may later garnishee her wages or get the sheriff to take her goods and sell them. Play your hand close to your chest, don't phone them, do it all by letter.

these are the type of people who wouldn't look at a letter. and i hope she tries to call cops for harrasment. i will just say i was not harrasing them i called once a night and i was looking for compensation for damage they did to my car.
I cant push them either they tell me they're poor and i wont get anything outta them, i think i will get a quote from her panel beating shop and get the money cash in hand. ther is no ****ing way im sending my baby to dumb ****ers

She just has to go the police, explain that you keep ringing her, that she doesn't want you to and bingo...interim AVO against you and you tehn can't contact her in any way at all.
The Police HAVE to act on a complaint from a female for an AVO and you then have to try and defend yourself and it costs $$$. You have the choice of doing it the legal way ( letters of demand) so you would have no defence at all.
The process of the letters is so that you end up getting judgement against her: it doesn't matter if she doesn't read the letters
F.F.S. Why are you telling us your story asking for advice and then not listening and going down the wrong path anyway???????????????????
Or you can claim against your insurance and they chase her. Let me guess you only have 3rd party.

05-07-04, 19:26 GMT+10#13 aus880, hypothetically if i took ur advice here is the senario. I waste my time writing, posting letters they probably wont read. i goto court and go look judge i did things the right way and he goes yes you did congratualtions thats if they even show up at court and how do poor ****s pay for damages after court fees?. and who ever told u that court is free is lost. to take someone to court i need a letter from a solicitor that states if the damages aren't paid within seven days a court date will be set. I am a 1st yr uni student studying mech engineering which is hard enough and even if i did have full comprehensive i'd still have to pay a premium to lodge a claim which 99% of the time they keep even if they do chase the people up. Also full compo for me is almost 3grand which is more than the car cost me. Where is the ****ing logic in that. And what are cops gonna do about a guy complaining, "someone wont pay for damamges", if u goto a cop shop and ask for help for a topic like that they will laugh at you and give you the run around crap.
your advice is for a system that doesn't ****ing work.

05-07-04, 19:31 GMT+10#14 and i have 3rd party but that doesn't do **** for me. Driving without insurance these days is insane. after rego, fuel, repairs, insurance a uni student is a poor ****er.
i need advice for a poor ****er who doesn't have the time on his hands to lodge letters or goto court.

05-07-04, 21:36 GMT+10#16 i've only been on this forum a short time and i like everything bout it but almost every thread that u posted has something negative in it.
I called the ladies mother up tonight and she says she will give me 200 on thursday wether or not she comes through with it i dont know but im glad im getting anything.
From the sounds of things aus880 u have never had an accident where people dont want to pay for your damamges. If u aint got anything positive to say in my threads DONT POST in them.
my 2 cents cya

06-07-04, 06:44 GMT+10#17 I've had several prangs where I've been hit by people unwilling to pay including one very similar to your situation.
I offered you advice based on my experience, albeit in NSW, but you aren't prepared to take any of it even though it has already worked for me and friends of mine very well. I'm amazed you aren't even prepared to do the letters of demand as they are so easy to do.
I hope you end up getting all/some money regardless but like I said beware if they are smart they can stuff you around for ages and cost you time and money: AVO etc
Good luck with it all and cheers

06-07-04, 09:10 GMT+10#18 Dude, f@cken wake up to yourself. Everything AUS880 has told you is the right thing to do. F@ck sake mate. The Police would have told you there was no need to report the matter because:
1. No one injured
2. DETAILS EXCHANGED (how did they know they weren't the right details?)
3. No vehicle needed towing
4. No one (?) under the infulence of alcohol.
When these criteria are satisfied, its called a 'P5' or a minor.
Now that she has given you false info the accident becomes a 'P4' - major, requiring Police intervention (in NSW anyway).
Hope this helps but you really need to start listening to the advice you ask for in the first place...

10-07-04, 15:49 GMT+10#19 What's the go with "I can't afford court procedeedings?".
Wouldn't this be dealt with by small claims court, ie: represent yourself? In which case, if you've got copies of the letters you've sent and a well documented paper trail, and she's got nothing, then you'll most likely get the judgement in your favour.
However, if you half arse it and do nothing, then you'll get nothing. If writing a few letters is too much hassle for you........

vltrb-0 Follow aus880' advice. He does know what he is talking about. Your going to get ****ed over. Don't complain about it to us when it happens. What Aus880 is trying to explain to you is that it dosn't matter whether or not she reads the letters. That sort of making sense to you? Phone them constantly it is going to backfire big time.
