All i can say is BUGGER! Bought my car a few weeks ago (Daewoo Cielo 1996) driving along on Friday stopped in traffic coz some dude was turning right... Some guy in a 2002 Holden Rodeo ute wasnt looking and ran up my arse (must have been going about 40km atlease) made me hit the car infront of me and that car hit the car infront of her... My car is F*CKED up HARD dunno if it will be fixable or not.. The lady infront of me had front end damage and the car infront of her had damage at the back only. But you cant understand how HURT my car is.. And scared the bejesus out of me, hurt my back and neck had to take 5days off work. But the bad things is that the guy has no insurance (and neither do i so i cant even get it fixed through my insurance) the guy wants at to go on a payment plan of bugger all a month. Im contacting lawyers about it and seeing what i can do but for now im catching a cab to work everyday or having to rely on Sean to take me. Is a hag coz i generally start work at 6am (airport) so im up **** creek. My advice GET INSURANCE!!! We need Petros' bat and orange gun huh!

Thats gotta suck the big one, hows your arse, a rodeo is pretty big to fit up there only jokes.. Hmmmmm report it to the police ASAP if you havent done so already. Take photos, witness names and all driver details. My advice, buy a gemie for 1k and drive that around. That way you still got wheels to get to work and back, otherwise you might loose your job. I thought you had a mini?

Ha yeah i DID have a mini and i DID have a phatt sigma re but yeah... no longer.. I went back to get quotes (we just assumed that it would be too ****ed to fix) and they 'officially' said that it is.. Rang around a few insuro places to find out the market value of it, $7.5k ish... Darkstar i did contact the cops about it the next day once i found out he had no insurance, they said that they didnt need to know about it coz noone was hurt (apparently my injuries werent bad enough to say i was "hurt") -Am thinking about getting just a 'ol cheapo run around to get to to work and stuff (lucky i can walk to the airport (work) somedays, when its not a 6am start, 9pm finish or wet) but also thinking of opting for that nasty personal loan and just getting something decent (no not a vl) ****ting thing is that ive gotta pay the legal fees at the moment to go ahead with it, not really money i have handy ($200 an hour for ne thing decent) Guess I have just gotta wait and see.. Hmmmm sounds Dodge! The insurance should at least PAY YOU out, but not pay him out, regardless of the defect. If he does have insurance, chase it up with them and force them to pay. If he has no insurance what so ever, its going to be a hard and long battle to get the money from him, but effectively you can sue him to get some sort of cash back, but depending on wage, the judge can order to pay you back 20 bucks a week over years which is bread and butter money instead of a lump sum. Hey end of the day i guess im at as much fault as the guy who hit me.. It was my own silly fault to not have insurance hey! And it just came down to being lazy!! I bought the car from my sister about 3.5weeks ago and the one thing she and her husband stressed to me was "GET A COVER NOTE" i was like yeah yeah i'll do that.. Never did... Drove home to Stawell one day, going thru the Pentland Hills (the hills just outta Melbourne heading towards Ballarat) at peak hour and it was dusk and pissing down rain - now i'll be the first to admit ive had bugger all experience driving in the rain and im not really confident when its heavy rain and espically in a new car (id only had the car like 2 or 3 days when i was doing this trip) i told Sean (housemate) that i'll definatly organise insurance when i get home to Melbourne a few days later coz i was actually 'scared' driving in heavy traffic, dusk and HARDCORE rain... But i still never did it... I spoke to my folks only about 3days b4 i had the accident saying i still hadnt organised insurance and they said they'd pay for it (that wasnt the issue why i hadnt got it but....) that made it all the more attractive for me to get it but i was still TOO LAZY to make a simple phone call... Now if i had, my understanding is that my insurance company would fix the car, or in my case pay me out the market value of the car (which is $7k which i said above, but i only bought the car for $3k coz i got it from my sister so what a bonus i could of had there hey) and then they would chase the guy that hit me and get the money out of him... Could have also had a courtasy car in the meantime.. Whos fault is that hey... MINE!!! I dunno much about defect notices (hehe i must be just about the only person on here that hasnt had one or had to really deal with them) but i "thought" that if he doesnt fix whatever he got the defect for within 7days then its like SET that his car isnt RW which means his reg is now expired, which means no insurance yeah...? I dunno, thats just what i thought and "assumed" (Never assume coz you make an ASS of U & ME - spells assume hehe) So now Sean (again housemate) has "connections" and has a family friend that is a lawyer or something so hes going to contact him for me and see what to do.. I spoke to a family friend who does 'family law' she told me i need to have 2quotes, write this fella a letter saying i need the money and if i dont hear from him within 14days solicitors will be after him.. (she also said to throw at him to get the money for my medical bills, my loss of work and the taxi fares to and from work - BUT hey, why bother even trying, im not doing this just to get money, i just some wheels) The place that have my car at the moment (AMI COLLISION CENTRE ESSENDON have be GEMS.. They have helped me out soooooo much its unbelievable.. Letting me keep my car at their factory for free (charge me for the initial tow and to keep the car there one day but the rest has been free so far - car accident happened last friday.. And they also said they would tow the car to wherever for me for free aswell b'coz they feel for me, for the horrible situation i am in..)) They contacted the fella about it and he said to them that he has no insurance and he wants to go on a payment plan.. (He initially told me and AMI that he does have insurance) I personally havent spoken to him since the accident, am planning on contacting him today (friday) about it though and just see what he is prepared to do, certainly not agree to a payment plan though, but i figure i personally need to make some sort of contact with him hey... I mean, i understand his position 100%, geez if it was my fault id be up sh|t creek (his car got hurt, mine has died, lady infront of my has front end damage aswell and the car infront of her minor damage i THINK) and id have to do the same, thats ALOT of money.. (it was initially via phone) maybe take in my medical certificates to show that i WAS injured (come on HAD to take 4days off work, the 5th day, well i could have worked but yeah i HAD to coz i was in HARSH pain.. Like i was taking Valium and i was still HURTING!!) but yeah if it goes to court i think im going to have to have all the 'right' and 'correct' documents etc to make it easier on my behalf.. But yeah end of the day, its just as much MY fault as it is his.. Learnt a lesson out of it for sure.. Im pissed i dont have a car it puts me out and it makes things hard for those around me (like Sean coz i gotta steal his car) but to be honest, im not really that pissed about it, i could have made the situation so much easier but i didnt.. Or worse... It could have been ME in HIS position!! *shivvers* Like i said, all i really want out of this is enough money to get me a run around car, the rest, well i dont care if i get it back or not really.. (damn would be good to get all of it BUT...) I paid $3k for the car so i'll be happy if i can get that back (although it IS worth $7k) im not too greedy... HMmmm i don't know wat to do in this situation but this is just off the top of my head. Bummer ey, i rekcon get some quotes on ur car (at least 3) for different places on the damage and the current market valve of the car. Get statements (if police came) get there incident number and the police statement. U have all the guys information, contact him by phone try and work sumthing out. Don't say u only brought the car for $3K don't do that ! If ur car is worth that its worth that, money is better in ur pocket then someone elses. Ey if u don't want the extra 4K u can always sent it my way, much appreciated. I think u should consult some form of legal aide for advice about the situation a hand, maybe even get him to write u up a letter of demand so u can send to the person. I think its sumthing like u need 3 quotes and include copies of em in a letter of demand. If he doesn't come up with the money i think it off to court u go. Hi ho hi ho its off to court u go.
